Terms and Conditions

These terms and conditions govern the contractual relationship between TECHNITRON BV (hereinafter 'Climapro', 'the Provider') and any person (hereinafter 'the Customer') ordering its services for installation, maintenance or repair of air conditioning, heat pump and ventilation systems.

2. 2

   Scope

   These T&Cs apply to any service performed by Climapro: quote, order, maintenance contract or repair. Any order implies full acceptance.

   Quote and acceptance

   Any quote is issued free of charge and valid for 30 days. The order is firm upon written acceptance by the Customer. Any later change requires an addendum.

4. 4

   Prices

   Prices are quoted in euros, VAT included. The reduced VAT rate (6%) may apply for works in homes older than 10 years, under legal conditions. Travel, supplies and options are stated in the quote.

   Payment

   Unless otherwise stated:

   • 30% deposit on order
   • Balance at completion, payable in cash or by transfer
   • Late payment triggers statutory interest (Act of 2 August 2002 in B2B) and a fixed indemnity of 40 EUR (B2B).

   Lead times

   Lead times are indicative. Climapro endeavours to meet them barring force majeure, supplier delays or late customer input.

   Right of withdrawal (consumers)

   Pursuant to articles VI.47 et seq. of the Belgian Code of Economic Law (transposing Directive 2011/83/EU), any consumer who has concluded a distance or off-premises contract has a 14-day withdrawal period without justification.

   The period starts on the day the contract is concluded (services) or on delivery (goods). The Customer exercises this right by an unambiguous notification to info@climapro.be or by post (standard form in annex).

   EXCEPTION: if the Customer expressly requests that performance begins during the withdrawal period and acknowledges losing the right once fully performed, the right ends after full performance.

   Legal guarantee of conformity

   Goods and works enjoy the legal guarantee of conformity (articles 1649bis et seq. of the Belgian Civil Code / Book VI CEL). For consumer goods, the guarantee is 2 years from delivery.

   Liability

   Climapro's liability is limited to direct, foreseeable damages. Indirect damages (loss of profit, loss of data) are excluded. This limitation does not apply in case of fraud or gross negligence.

    Force majeure

    Neither party is liable for failure resulting from force majeure (natural disaster, general strike, pandemic, critical supplier outage, etc.).

    Intellectual property

    Any document, plan or study delivered by Climapro remains its intellectual property.

    Personal data

    Data collected in the contractual relationship is processed in accordance with our privacy policy.

    Mediation and disputes

    In case of dispute, the Customer should first contact Climapro. Failing amicable resolution, the Customer may contact:

    The courts of Brussels district are competent, without prejudice to EU consumer protection rules.

    Applicable law

    These T&Cs are governed by Belgian law.
